1. TO ENTER AND PLAY: Beginning at 12:01 AM (EST) on 11/1/03 until 11:59 PM (EST) 2/28/04 (the "Entry Period"), you can enter When The Sun Goes Down T-Shirt Sweepstakes by visiting the When The Sun Goes Down website (www.bluebirdjazz.com/whenthesungoesdown) and completing the entry form during the Entry Period or by mailing in an entry during the Entry Period to the When The Sun Goes Down T-Shirt Sweepstakes, c/o Bluebird Jazz/ Arista Associated Labels, 1540 Broadway, New York, NY 10036. Write-in entries must be postmarked by 2/28/04 and received by 3/5/04. Hand canceled or metered write-in entries are void. All entries must include your full name, complete address (including zip code), email address (if applicable), birth date and daytime telephone number to be eligible. An entrant may enter via the online method or the write-in method.
2. CONDITIONS OF ENTRY: If you are entering via the online method, you, or your parent or legal guardian, must be the Registered and Authorized Holder of the Email Account through which the entry is made. For purposes of this sweepstakes, a "Registered and Authorized Holder of the Email Account" is defined as the natural person who is assigned to an email address by an Internet service provider, online service provider or other entity (e.g., business, educational, institutional, etc.) that is responsible for assigning email addresses for the secondary level domain name associated with the submitted email address. Entries must be made by an individual from a single computer and may not be made by proxy, or electronic means such as script, bot, macro or any other similar software or program. All entries become the property of Bluebird Jazz. Neither Bluebird Jazz, its parent, nor its affiliates, subsidiaries, divisions, advertising and promotion agencies, are responsible for the incorrect or inaccurate submission of entry information, human error, late, lost, damaged or illegible entries. Limit one entry per eligible person. Multiple entries by a single entrant will disqualify the entrant. Any person who attempts or otherwise encourages, directly or indirectly, the entry of multiple forms or false contact information under multiple identities or uses any device or artifice to enter or encourage, directly or indirectly, multiple or false entries will be disqualified. Bluebird Jazz reserves the right to cancel or modify the sweepstakes if it determines, in its sole discretion, that fraud or any other corrupting or unlawful force or influence has destroyed the integrity of the sweepstakes.
3. ELIGIBILITY: The sweepstakes is open only to U.S. residents (excluding Puerto Rico) who are 13 years or older prior to the Start Date. Online entrants must have an Internet online service provider account in good standing with either free Internet access or a flat-monthly fee structure as of the Start Date. The sweepstakes is not open to employees of Bluebird Jazz, their affiliates, subsidiaries and advertising and promotional agencies, and the immediate family members of, and any persons domiciled with, such employees. The sweepstakes is governed by United States law and is subject to all federal, state and local laws. Void where prohibited by law. Entries that do not comply with these official rules (the "Official Rules") in all respects are ineligible and void.
4. PRIZES: Five (5) winners will be selected to receive a XL T-Shirt. The estimated retail value of the prize is $25 No assignment, substitution or transfer of the prize is permitted. No cash alternative for the prize.
5. ODDS: Odds of winning depend on the number of eligible entries received during the Entry Period.
6. DRAWING AND WINNER NOTIFICATION: The prize winner for the sweepstakes will be determined on 3/10/04 by a random drawing from all eligible entries received during the Entry Period. The random drawing will be conducted by Bluebird Jazz, or a designated representative of Bluebird Jazz, whose decisions are final with respect to all aspects of the sweepstakes. Sweepstakes entrants do not have to be present at the drawing to win. The winner will be notified by telephone, mail and/or email and or you can receive the name of the winner by mailing a self-addressed, stamped envelope to BMG- Arista Associated Labels, Attn: New Media Department, 1540 Broadway, New York, NY 10036. The winner will be given seven (7) days from the time Arista sends notice to respond to claim the prize. Failure to respond or a return of prize notification as undeliverable may result disqualification and an alternate winner may be selected. The winner will be required to complete an affidavit of eligibility/publicity and liability release (except where prohibited by law), which must be returned within 48 hours of receipt. Failure to sign and return the affidavit or release within 48 hours or receipt, or to comply with any term or condition of these Official Rules, may, at the sole discretion of Arista, result in disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate winner.
7. PARTICIPATION: Participation in the sweepstakes constitutes the entrant's consent to the publication and use of his/her name or likeness in any media for promotional purposes, including, without limitation, on-line announcements, without additional compensation except where prohibited by law.
8. LIMITATIONS OF LIABILITY AND REMEDY, AND GENERAL RELEASE: By entering the sweepstakes, each entrant agrees that any disputes, claims, and causes of action arising out of or connected with the sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action. Further, all entrants release Arista, its parents, affiliates, directors, officers, employees, representatives, partners and agents from and against any liability whatsoever for any claims, costs, injuries, losses or damages or any kind arising out of or in connection with the sweepstakes or arising our of or in connection with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
9. CONSTRUCTION: All issues and questions concerning the construction or interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions (whether New York or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than New York.
10. SPONSOR: The sweepstakes is sponsored by Bluebird Jazz whose decisions regarding the selection of the winner and all other aspects of the sweepstakes shall be final and binding in all respects. Bluebird Jazz will not be responsible for any typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the sweepstakes.
